This privacy notice governs how Patagonia Europe Coöperatief U.A. (“Patagonia”, “we”, “our” or “us”) collects, uses, maintains and discloses information collected from users (each, a "User" or “you”) of the eu.patagonia.com website ( the “Site”) and customers in the retail stores we operate in Europe.
Who is responsible for the processing of your personal data?
Patagonia is responsible for the processing of personal data obtained through the Site or through our retail stores in accordance with the EU General Data Protection Regulation (GDPR) and other applicable laws and regulations, because we determine how and why your personal data is processed. See “Contacting us” below for how to contact us.
What personal data do we process, for what purposes and on what grounds?
Any information related to a person that can be used to identify them directly or indirectly is personal data.
Patagonia collects personal data from you when you open an account on the Site, place an order for our products, request a repair, contact our customer service, subscribe to our mailing list, participate in a contest or promotion, respond to a survey, provide a product review or otherwise fill out a form on the Site, or sign up to support a petition or attend a Patagonia event.
Patagonia may process the following personal data collected on the Site: name, gender, email address, Universal-Unique-Identifier (UUID) (unique online identifier that is only used on our website), IP address, billing address, shipping address, postal code, country, phone number, language preference, sport interest, details of purchases, details on returned goods, correspondence exchanged between you and our customer service team, and your feedback in surveys, product reviews (including photos and videos that you upload) and in customer service reviews.
If you request a repair or make a purchase at any of our retail stores, we may collect your complete name, postal, billing or delivery address, email address and telephone number. If you signed up to be part of our Retail VIP List upon invitation of our retail store staff, we collect your email address to send you information about store-specific events.
If you signed up for membership in our Pro Community, we collect your complete name, telephone number, email address, sport interest and other information you submit at the time of your application such as the links to your website or social media page. We will use the personal data you provide in order to manage the Pro Program, which includes sending you personalized emails based on your consent about relevant activities and other matters in your area of interest or place of residence.
We use your data for purposes of creating your account, fulfilling your orders, processing your returns and addressing customer service queries in order to fulfil our contractual relationship with you. We use an automated fraud engine when processing your order to determine if your order can be accepted.
We process your personal data to send you emails as described in “Email Communications” below.
We also process your personal data to meet our legal obligations and for our legitimate interest to operate our business and provide services to you, except in cases where our interests are overridden by your interests or fundamental rights and freedoms which require protection of your personal data.
Processing of personal data by social media networks:
We have implemented one or more social media pixels or other Java script enabled trackers on the Site (“social media pixel”). Social media pixels are made available to us by the relevant social media platform. They enable us to identify you if you landed on the Site by clicking on an ad or a link that we published on the social media platform and identify to us which products you subsequently acquired from us. The tracker drops a cookie on your computer or mobile phone when it is first loaded by your browser or app. By means of the tracker, the social media platform and Patagonia collect your IP address (including associated location information), your user agent or browser string and specific information on how you interact with the Site. The user agent or browser string provides the basics as to which operating system your computer or mobile phone is running, basic security information, screen resolution and the Internet browser that you are using. The social media platform processes all personal data it obtains by means of the social media pixel in accordance with its privacy statement. We use the personal data provided by social media pixels to measure the effectiveness of our ads and other communications on social media platforms.
We send you emails on the following occasions:
Order Fulfillment: We will send you emails to confirm an order or cancellation of an order; to request information to complete your order; to process returns; and to provide status updates on your orders, cancellations or returns.
Site back up: If the eu.patagonia.com website is experiencing technical difficulties, we will send you one email when it is back up if you provided your email address for this purpose.
Product Repairs: We will send you emails to inform you about the status of your request for product repair.
Back in stock: We will send you one email to inform you when the product you wished to purchase is back in stock if you provided your email address for this purpose.
Event notifications: We will send you emails to keep you informed about Patagonia events that you signed up for.
Product reviews: If you purchased a product, we may send you an email in order to improve our products and to provide you with an opportunity to share your opinion.
Newsletters/Retail VIP List: If you decide to subscribe to our mailing list/Retail VIP List, you will receive emails about Patagonia products, sales, promotions, store events, environmental action alerts. You can decide to sign up on the Site, at one of our retail stores or we can invite you to sign up via a pop-up invitation. Emails may be personalized according to gender, language, country and sport interest(s) that you indicate. If at any time you want to unsubscribe from receiving future emails, you may do so by following the unsubscribe instructions at the bottom of each email or by using the link in the section “Your rights and withdrawal of permission” below.
Pro Community Emails: If you signed up to receive emails as part of our Pro Community, we will send you emails about relevant activities and other matters in your area of interest or place of residence. If at any time you want to unsubscribe from receiving future emails, you may do so by following the unsubscribe instructions at the bottom of each email or by using the link in the section “Your rights and withdrawal of permission” below.
Participating in a petition
In specific campaigns we may ask you to participate in a petition. This means that you subscribe to an online statement supporting an environmental goal or viewpoint. Such a statement will be directed towards a particular government organization or other relevant stakeholder. For this purpose, we will process your email-address, first name, last name, country and postal code. Your participation is based on your consent. As part of our consent message we will also request that you agree to receive our environmental action alerts and invitations. If at any time you want to unsubscribe from receiving these emails, you may do so by following the unsubscribe instructions at the bottom of each email or by using the link in the section “Your rights and withdrawal of permission” below.
Capturing user feedback
Patagonia engages the services of third parties to conduct surveys and capture feedback from its Users to improve the usability and experience of the Site. Patagonia would like your feedback on what parts of the Site you like or what you would suggest to improve. Neither Patagonia nor these third parties will use your personal data captured with your feedback for any other purpose than mentioned in this notice or in the survey. Any personal data (e.g. email, phone number, address, etc.) provided with your feedback will only be used by Patagonia to contact you with further questions about your feedback, should Patagonia deem it necessary.
Providing product and customer service reviews
Patagonia makes use of the services of a third party to invite Users to submit online reviews related to its products and customer service. When you buy a product from us, we may invite you by e-mail to conduct a review as mentioned above. You may also post a product review when you are logged into your account. If you consent, Patagonia may publish the review on its website under the name that you provide. You can of course also provide an anonymous review.
Storage period of personal data
We will retain your personal data for as long as you maintain an account or as otherwise necessary to fulfil our contractual relationship with you.
We will also retain your personal data as necessary to comply with our legal obligations, resolve disputes and enforce our agreements. Where we no longer need to process your personal data for the purposes set out in this notice, we will delete your personal data from our systems. Where permissible, we will also delete your personal data upon your request; information on how to make a deletion request can be found in the section “Your rights and withdrawal of permission” below.
The storage period of personal data processed using social media pixels is determined by the relevant social media platforms which are listed in our Cookie Notice.
The storage period of personal data processed using cookies is determined by your engagement with our website. If you have not visited our website for at least 2 years we will remove the historic record of your interaction data.
The storage period of personal data processed by our service providers and other third parties (see below) who are independent controllers is determined by their respective privacy notices.
Your rights and withdrawal of permission
You have the right to opt-out of the use of your personal data by Patagonia for our mailing list or other direct marketing purposes at any time. You may do so by either clicking the unsubscribe option at the bottom of each email or by making a request to us through our data subject access request portal located here.
You also have the right to request an overview of your personal data processed by Patagonia, object to or restrict its processing, and request removal or correction if your data appears incorrect or irrelevant, by making a request to us through our data subject access request portal located here. Please note that if you request the removal of or restrict the processing of some or all of your personal data, we may not be in able to meet our contractual obligations with you or respond adequately to your customer service queries.
If you wish to opt-out from the social media pixel please change your cookie preferences on our Site and withhold your consent for advertising cookies. When you do so, the social media platform will no longer receive your personal data through our Site. The social media platform will however retain historic data related to your cookie id. Any request related to such historic data will need to be directed to the relevant social media platform. In addition, you have the statutory right to complain to a competent data protection authority.
Providing and sharing your personal data
Our Group Companies
Patagonia employees, including some employees based in the United States, may have access to your personal data. Access rights of our employees are limited and granted only on a need to know basis, determined based on their job functions and roles.
Services Providers and Other Third Parties
Patagonia may also share your personal data with third parties including logistics providers, product repair centers, workflow software suppliers, email service providers, e-mail form (pop-up) providers, CRM providers, address verification service providers, online User review service providers, ecommerce platform providers, fraud engine providers, payment service providers, order management system providers, petition organizers, event management platforms and social media platforms. We use the services of these third parties to process your purchases, payments, returns, repairs and complaints, to send you marketing and promotional email communications, e-mail invitations to participate in Patagonia surveys or reviews, or email with information about a petition or Patagonia event that you signed up for. To the extent that such third parties are data processors, they are contractually bound by Patagonia to only process data in accordance with Patagonia’s instructions and applicable legal requirements. Some of these third parties, for example logistics providers, petition organizers and event management platforms, are independent controllers, meaning that they determine the purposes for which and the manner in which your personal data is processed. Transfers Outside the EEA
All transfers of personal data to either Patagonia employees, our affiliated group companies or to third parties who are located outside the European Economic Area (comprising all the EU countries plus Iceland, Liechtenstein and Norway) are subject to the EU Standard Contractual Clauses.
Links with third party websites and social media
Users may find advertising or other content on the Site that link to the sites and services of Patagonia’s partners, suppliers, advertisers, sponsors, licensors, social media and other third parties. Patagonia does not control the content or links that appear on these sites/social media outlets and is not responsible for the practices employed by websites/social media outlets linked to or from the Site, except for official Patagonia campaigns or official Patagonia social media posts. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interacting on websites and social media outlets which have a link to the Site is subject to that website's or social media outlet’s own terms and policies.
Changes to this privacy notice
Patagonia has the discretion to update this privacy notice at any time. When Patagonia does, Patagonia will revise the updated date at the bottom of this page. Patagonia encourages the Users to frequently check this page for any changes to stay informed about how Patagonia is helping to protect the personal information Patagonia collects.
